Pa. woman sues Google over Gmail privacy, ads

PHILADELPHIA (AP) -- A Pennsylvania woman has accused Google Inc. of illegal wiretapping for "intercepting" emails she sent to Gmail accounts and publishing content-related ads.

Her lawsuit echoes others filed around the country by class-action lawyers who say the practice violates wiretap laws in some states. They represent email users who do not have Gmail accounts and have therefore not signed the company's acceptance terms.

"The terms are that Google can intercept your emails and use them for direct marketing purposes," said lawyer Richard M. Golomb, who has sued Google in Pennsylvania, Maryland and Florida. "They are also intercepting emails of the non-Gmail account holder, in violation of wiretap laws in some states."

In court filings in the Maryland case, Google acknowledged that it routinely scans emails for spam and computer viruses, but said that's permitted under similar federal wiretap laws.

Google argued that selling advertising based on the content of a received email is a routine business practice permitted under an exception written into the wiretap law. Google notes Yahoo and other email providers sell ads through similar methods.

"There can be little doubt that selling advertising in order to provide a free service to consumers is a 'legitimate business goal,'" Google lawyer Michael G. Rhodes and others wrote in a Nov. 9 motion to dismiss the Maryland case. "If it were not, then the entire model by which content is provided on the Internet would be illegitimate, as would the business model by which television programming has been provided for free for the last half century."

Courts reviewing email wiretap cases have repeatedly held that "parties expect and impliedly consent to having their communications intercepted and recorded whenever they use email," the Google lawyers wrote. Rhodes did not immediately return a call for comment Monday.

At least one electronic privacy expert called it "a bit of a stretch" for Google to compare a search for advertising leads to rooting out spyware.

"People think when you send a message, communications companies can filter out spam and malware, and that's correct. But filtering out spam and malware is not the same as looking at the content of the email to (find) keywords for advertising purposes," said Marc Rotenberg, executive director of the Electronic Privacy Information Center.

"(What) if you were making a call on your Verizon cellphone, and you were talking to an Italian restaurant trying to make reservations for Friday and a Verizon agent jumped on the line and said, 'Oh, how about this place?'" Rotenberg said. "You're not supposed to be listening to my communications to try to sell me stuff ? even if it's a better restaurant."

The Philadelphia plaintiff, Kristen Brinkman, does not have a Gmail account and never signed the company's acceptance policy, according to her Nov. 30 lawsuit, which has been assigned to Senior U.S. District Judge Anita B. Brody.

Google wants the various legal disputes resolved in northern California, where the first such lawsuit was filed in June. The area is also home base for Google, which is headquartered in Mountain View, Calif.

Could winning out save coaches on the hot seat?

Andy Reid got such a hearty hug on the sideline from Howard Mudd that the 70-year-old assistant with the artificial hip actually lifted the burly head coach off his feet.

Norv Turner received a game ball from the team president.

Reid and Turner were just two of four coaches on the hot seat who celebrated wins on Sunday, joining Ron Rivera and Pat Shurmur.

Reid's Philadelphia Eagles (4-9) snapped an eight-game losing streak when rookie Nick Foles threw a touchdown pass with no time left to beat Tampa Bay 23-21.

Turner led the San Diego Chargers (5-8) to their first regular-season victory in Pittsburgh in 15 tries. A 34-24 win over Ben Roethlisberger and the Steelers kept the Chargers mathematically alive for a wild-card playoff berth.

Rivera watched his Carolina Panthers (4-9) build a 23-0 lead against NFC South champion Atlanta and hold on for a 30-20 upset.

Shurmur is actually getting used to winning in Cleveland. The Browns (5-8) beat Kansas City 30-7 for their third straight victory to also keep slim playoff hopes alive.

But, is it too late for any of the four coaches to save their job?

"Listen, I'm not worried about any of that," Shurmur said Monday. "I'm not worried about saving, I'm worried about doing my job and that's it. I just want to do my job."

He could've been speaking on behalf of the other coaches, too.

"That's not the thing that's on my mind," Turner said about his job status. "We're trying to get ready for Carolina and trying to build on what we did. That's where I'm at."

Reid and Rivera have expressed similar thoughts whenever asked.

Of the four, Reid may have the least security, even though he's been the most successful among the group and is the longest-tenured coach in the NFL at 14 years.

Reid is assured his third losing season and second in a row. The Eagles entered each of the last two seasons as Super Bowl contenders and failed miserably. Team owner Jeffrey Lurie already gave Reid a directive before the season, saying the Eagles had to make "substantial improvement" on their 8-8 finish from last year.

It's a foregone conclusion in what-have-you-done-for-me-lately Philadelphia that Reid won't be back. Local comedian Joe Conklin and his daughter, Casey, put together a video parody of Taylor Swift's song "We Are Never Ever Getting Back Together" mocking Reid. It's called: "We Are Never Ever Gonna Win With Andy." The video already has nearly 400,000 views on YouTube.

Fans and media have speculated about Reid's potential replacement and the nature of his departure for months. The only question here is whether Reid steps down or is fired.

But Lurie and Reid are closer than a typical owner-coach relationship. Reid also is due to make about $6 million in 2013. So, it's not entirely unreasonable to think Lurie could let him finish his contract, especially if the Eagles win the final three games.

Lurie could cite several reasons, including turmoil and injuries. Reid fired defensive coordinator Juan Castillo in October and defensive-line coach Jim Washburn last week. Michael Vick, LeSean McCoy and DeSean Jackson ? the team's top three offensive players ? have missed a total of eight games. The offensive line was decimated by injuries.

There's also the rookie quarterback factor. Foles has shown signs of being a long-term answer. Reid was hired by the Eagles largely due to the role he played in developing Brett Favre when he was an assistant in Green Bay. Donovan McNabb had an outstanding career under Reid in Philadelphia. Perhaps Lurie would want to keep Foles in proven hands.

All that said, the city might riot if Lurie doesn't part ways with Reid.

There wouldn't be upheaval in San Diego if Turner stays. But that's unlikely. The Chargers are headed toward a third straight year out of the playoffs, and are one loss away from their first losing season since 2003.

Chargers president Dean Spanos is expected to fire Turner and general manager A.J. Smith shortly after this dismal season ends. Reid, by the way, has been mentioned as a potential successor.

In Carolina, Rivera is coaching like a guy who expects to return. He's playing younger guys and preparing them for the future whether he's part of it or not.

The Panthers fired GM Marty Hurney after a 1-5 start. At that time, Rivera said he was told by owner Jerry Richardson the team needs to be "trending upward" the rest of the season. The Panthers are 3-4 since, including the impressive win over the Falcons.

Richardson hasn't talked about his plans. He does have to hire a new GM, who likely would want to bring in his own coach.

"The disappointing thing is that's what we can be," Rivera said after the win over the Falcons. "We know that. Based on what we did, how we did it and who we did it with, that's the disappointing thing. ... We've found balance, we have. Unfortunately, we didn't do it sooner."

Shurmur could make the best argument to keep his job. The Browns are 5-3 after an 0-5 start and they have a roster filled with young players. Cleveland's rookies have combined to make 72 starts ? a league high.

"That's good for the future because we're finally starting to find how to win football games with these young players," Shurmur said.

Whether that future includes Shurmur remains to be seen.

New owner Jimmy Haslam and new CEO Joe Banner may want to hand-pick their own coach to run the franchise. But if the Browns win out and finish the season on a six-game winning streak, firing Shurmur would be hard to justify.

Other coaches who could be looking for employment include Tennessee's Mike Munchak. The Titans (4-9) have lost five of their last six, and owner Bud Adams put the entire franchise on notice following a 51-20 loss to Chicago on Nov. 4.

Munchak, who has a year left on his contract, fired offensive coordinator Chris Palmer two weeks ago and may have to make other staff changes to keep his own job when this season ends.

In Buffalo, Chan Gailey appears safe despite the Bills (5-8) being headed toward their 13th straight season out of the playoffs. Gailey is just 15-30 with the Bills, but general manager Buddy Nix has insisted he has no intention of firing him.

Reid, Turner, Rivera, Shurmur and Munchak haven't received similar votes of confidence.

Long-distance solute transport in trees improved by intercellular pathways in living woody tissues

As large organisms, trees face some remarkable challenges, particularly regarding long-distance transport and communication. In addition to moving water and nutrients from their roots to their leaves, they must also integrate cell-to-cell communication over large areas. Furthermore, in order to function as a single, cohesive organism they must be able to effectively and efficiently send vital substances?such as DNA regulating signals?long distances along a network of cells, sieve-tubes, and vessels.

But how effective is this cell-to-cell communication and how far can such solutes travel?

Xylem and phloem serve as the two main arterial systems within a plant, and substances travel along two main pathways. Apoplasmic transport, in the system of cell walls, is important for movement of water and mineral solutes. Symplasmic transport, in which openings in the cell walls allow the cytoplasm of cells to be connected, facilitates the transport of nutrients, small ions, hormones, and transcription factors along a series of cells. Although this intercellular transport system is crucial for regulating cell differentiation and subsequent tissue maturation, it is not known how extensive these symplasmic pathways are and whether they can effectively transport solutes long distances.

The fact that woody tissues?specifically secondary xylem?contain long-living parenchyma cells, in addition to the dead cells primarily responsible for water transport, led Katarzyna Soko?owska and Beata Zag?rska-Marek (University of Wroclaw, Poland) to investigate whether symplasmic pathways in these living cells might play an important role in transporting solutes from xylem to actively dividing tissues, such as the cambium. They've published their study in the most recent issue of the American Journal of Botany.

"Molecular transport of hormones and other signals in cell-to-cell communication is slow," notes Soko?owska. "Yet information is propagated quickly over large distances such as a tree height or width. Moreover, billions of cells building up a tree must quickly and efficiently communicate with one another. This is a necessity for maintaining this large organism's integrity throughout its development."

Soko?owska and Zag?rska-Marek, in order to determine whether they could visually trace the pathways of solutes as those solutes travel up the living cells of the xylem network, cut 1- to 3-year-old branches from maple (Acer pseudoplatanus) and poplar (Populus tremula x P. tremuloides) trees and immersed the cut ends in a solution containing one of several fluorescent dyes.

After leaving the branches in the dye solutions for 3 to 7 days (adequate time for the dye to move a substantial distance), the authors cut cross- and tangential sections of the branches and found that dye was present in the living cells of both the radial and axial xylem parenchyma and ray and fusiform cambial cells?clear evidence that symplasmic transport occurred in both the secondary xylem and the cambial tissues. Moreover, dye was not only clearly seen in the cytoplasm of the cells, but also in the cytoplasmic bridges spanning walls between adjacent cells, confirming intercellular movement.

"Through the fluorescent marker application, we have successfully been able to visualize the transportation routes of nutrients or signaling molecules, which are regulated by changing states of cell-to-cell conductivity in time and in space," said Soko?owska. "They can be compared to traffic lights on crossroads, which control the road traffic and highway networks, ensuring fast and smooth transport between distant places."

Moreover, by using different dyes, the authors were able to see differences between the apoplasmic and symplasmic pathways. Although the apoplasmic dye was present in the cell walls of the secondary xylem, it was not visible in the cambial primary cell walls. This, together with the presence of the symplasmic dye in the cambial cells and in axial and radial xylem parenchyma, indicates the importance of the symplasmic pathway for transporting substances from the living xylem cells to the actively dividing cambial cells, which are crucial for developing new cells and tissues.

One of the most surprising and interesting finds was that the dye was not evenly dispersed throughout the cells despite the regular arrangement of rays in the cambium.

"We found that when fluorescent tracers are loaded to tree branches and migrate freely in the system of living cells, the tracer distribution becomes uneven," commented Soko?owska. "The regions appear with a high and low tracer content in the cells and they alternate along the branches. The pattern emerges in cambium, an embryonic tissue responsible for thickening of a tree through making its secondary conductive tissues, such as wood."

Father up from the source of the dye, the branch regions of rays filled with dye alternated with regions of rays that did not contain the dye?both dye and non-dye rays were composed of living cells with vigorous cytoplasmic streaming. The authors suggest that this pattern could be the result of differences in regulating the intensity of movement and unloading of dye from xylem to cambial cells in different areas.

"Most importantly, this regulation at the cellular level has a potential, through the spatial shift of the cellular states, of propagating important information in the whole population of interconnected plant cells over long-distances?similar to the green wave of streetlights for driving cars," Soko?owska stated.

In addition, this long-distance symplasmic movement from the xylem into the cambial rays is of utmost importance because the cambial cells are zones of active cell production and the intensively dividing cells in this region require many nutrients.

"Nowadays we are getting closer to understanding how cell-to cell communication can be translated into higher levels of plant body organization," Soko?owska concludes. "Cambium is a plant tissue composed of immortal, ever-dividing cells, equivalent to stem cells in animals. The more we learn about the mechanisms governing their functions, the better perspectives we get for directing morphogenetic processes in plants, animals and possibly humans."

"The wood produced by cambium is used commercially," she adds. "So, knowledge about cambial function and its regulation is also important for future modification of wood production quality."

A brain cancer diagnosis can send chills through the strongest of individuals, but a second diagnosis after beating brain cancer once before could bring someone to their knees.

Michael Moyles, a boy with the dream of becoming a United States Air Force officer followed that dream and in 1994 commissioned in the Air Force.

Unfortunately, after marrying his longtime girlfriend and earning the rank of captain, Michael was diagnosed with brain cancer in 1999. He fought through the cancer and had the tumor removed from his brain in 2001. He continued with his career in the Air Force after passing a medical board. For four years he was cancer free, but the unwelcome guest would return.

On Jan. 5, 2005, Michael was informed by doctors the cancer had returned. Not only had the cancer returned, but it was much larger and more aggressive.

No time to watch and wait ? the cancerous tumor was engulfing Michael?s entire right frontal lobe, and doctors decided they would have to remove that part of his brain.

That spring, Michael would endure a right frontal lobectomy ? the removal of the entire right frontal lobe ? at Cedars Sinai Medical Center in Los Angeles, Calif. This second surgery was exactly four years later to the day of his first brain surgery and once again, Michael?s wife would spend their wedding anniversary trying to hold herself together while her husband was under the knife ? in the fight for his life.

?This again?? asked Angela, Michael?s wife. ?You would think it would be easier the second time, but the mind is funny ? somehow you know what to expect, but for some reason that isn?t very comforting. You know it?s going to be about seven to eight hours of waiting, but you don?t dare go get something to eat, drink or just walk around ? you might miss something, anything! Even though you know the doctors won?t possibly be out for an update during the first two to three hours, because it takes that long just to get him under anesthesia and opened up, you don?t move from that chair. It?s exhausting; simply exhausting.?

Fortunately, the surgery was successful and Michael?s entire right front lobe was removed, including the cancerous tumor that had been spreading like a wildfire.

Incredibly, Michael?s vital signs were just as strong after surgery as they were before surgery. Then, in a step unprecedented at Cedars-Sinai, he was moved directly from the recovery room to a regular patient room, skipping intensive care completely. Once again he was completely unaffected by the surgery and left the hospital two days later. The doctors had never seen this kind of resiliency after brain surgery.

Michael considered the return of cancer as a wakeup call. He wasn?t just going to beat cancer by sitting back and hoping it wouldn?t show up again, he would have to fight. He knew his future rested solely in his hands.

He set out on a journey to get in shape ? not just physically, but mentally, emotionally and spiritually. He was going to leave no ground for cancer to stand on.

Not able to perform contact sports, Michael had to find something that he could safely do to prepare his body for this battle, so he decided to take up running. Not known for running, and actually not a fan of it at all, Michael set out by running 90 feet one day, then a lap around the track, then a mile and eventually more than 10 miles a day.

?Basketball was always a hobby, something fun to do and a way to stay in shape,? said Angela. ?His new fitness regimen was on a different scale ? nothing you would ever dream possible from a two-time brain cancer survivor.?

Since the cancer had returned a second time, doctors at Cedars Sinai Medical Center made the decision to start chemo to prevent a third sighting. Michael underwent 12 rounds of chemotherapy and, after passing another medical review board, was still be able to serve in the Air Force.

Six months after his second brain surgery, while still going through chemotherapy, Michael ran his first marathon.

?It wasn?t very fun or very fast, but I wanted to be clear that I?m not going to let cancer stop me from doing anything,? said Michael.

Michael never went a day without running while going through chemotherapy.

?Michael is truly a man of God,? said Angela. ?God made him extremely special. There aren?t many people with his drive and passion for life. When he said he was going to win this battle, he meant it and I knew it! I knew no matter how irritating his determination can be, it was a gift from God and I had to allow myself to get out of his way and let him do what he felt best to beat this ugly thing called cancer. He amazes everyone he meets, including the doctors. It?s not easy being the spouse of a cancer patient. There is nothing you can do to help, but be supportive and make sure their focus stays on the right thing. Other than that you feel helpless!?

The chemotherapy took a toll on Michael. He experienced nausea, vomiting and severe fatigue. He would go through five consecutive days of chemotherapy, and then allow 23 days for his immune system to recover. Michael described it as death on two legs for a full year.

Michael kept his head up and continued to work on getting in shape ? mentally, physically, emotionally and spiritually. After 12 rounds of chemotherapy within a year and with two marathons under his belt, Michael was still cancer free. He had beaten the beast again, and did it his way.

?After recovering from two surgeries and a year of chemotherapy, you could easily feel beaten down or defeated, but running marathons counters that ?defeated? feeling with total exhilaration and victory,? said Michael. ?I started to feel like I was really living and that the cancer wasn?t going to stop me.?

The emotional high of beating cancer for a second time would not last long. Shortly after completing his year of chemotherapy, during a routine checkup, Michael learned that the cancer had returned for a third time.

This was devastating news for a man who had put so much effort and energy into fighting, but he stuck to his Air Force mindset ? persevere through adversity, rise above all obstacles and never give up.

Michael would have to go through 10 more months of chemotherapy to try and stop the growth of the tumor.

Time management was the biggest issue,? said Michael. ?Fighting cancer, all the treatments, training for marathons, and a full-time job is enough to exhaust anyone even if they aren?t on chemotherapy. Chemo was the same ? minimal side effects until round nine and 10, then just miserable?

Having now gone through 22 rounds of chemotherapy, Michael had been through hell and back and then some. When the 10 months were up, doctors performed a brain scan to see if the cancer was responding to the chemotherapy. But, the cancer had continued progressing, even during chemotherapy. This could only lead to one thing ? he would have to go through a third brain surgery, a door no man or woman would want to open even once in a lifetime.

?Michael is the strongest man I know ? not just physically, but mentally and spiritually,? said Angela. ?Up at five in the morning, he exercises every day, studies, and by the time he leaves for work or by the time the rest of the house is awake, he?s already done more than most people accomplish in a whole day.

?Cancer had no idea what it was in for when it decided to attack him,? said Angela. ?It will lose.?

DALLAS (AP) ? George P. Bush, a nephew of former President George W. Bush and son of one-time Florida Gov. Jeb Bush, has made a campaign filing in Texas that is required of candidates planning to run for state office, an official said Thursday night.

The younger Bush, a Fort Worth resident, filed a campaign treasurer appointment Wednesday, a requirement for someone to become a candidate under campaign finance law, Tim Sorrells, general counsel for the Texas Ethics Commission, told The Associated Press.

Sorrells said the report does not specify what office Bush might seek, if any, and he had no other details on the filing, which wasn't available online. Bush did not immediately reply to an email seeking comment, and no phone listing for him could be found.

The 36-year-old said in September his goal was to run for office and acknowledged that he had his eyes on several statewide offices.

Raised in Florida, Bush decided to settle in Texas, home to his uncle and his grandfather, former President George H.W. Bush. He runs a consulting firm and has been active in Republican Party outreach to college students. He's also the co-founder of Hispanic Republicans of Texas, a group that seeks to elect Hispanic candidates.

Ana Navarro, who was the national Hispanic co-chairwoman for John McCain when he ran for president in 2008, tweeted her enthusiasm Thursday.

"Wrote check for my friend, (at)georgepbush newly formed exploratory committee for office in TX. Young, pragmatic, Hispanic, just what GOP needs," Navarro's tweet read.

Bush and his wife, Amanda, met while attending law school at the University of Texas at Austin. After working as a lawyer, Bush became a partner in a real estate investment firm. He has started his second company, St. Augustine Partners, a business consulting firm aimed at small- and medium-market energy industries.

Bush also has Navy service on his resume, including a six-month deployment to Afghanistan, where, for security purposes, he was given a different name. Not even those he was serving alongside knew he was a Bush.

Rights group: 4 Tibetans self-immolate on same day

(AP) ? Three teenage monks and a Tibetan woman set fire to themselves to protest Chinese rule on the eve of a pivotal Communist Party congress, activists reported Thursday, in what they said were the most such protests in a single day.

Free Tibet director Stephanie Brigden also said that the protesters, as young as 15, were the youngest to self-immolate and that the timing of Wednesday's protests in ethnic Tibetan areas of China appeared aimed at the party's weeklong conference to unveil the country's new leadership that opened Thursday.

The three monks set fire to themselves Wednesday afternoon outside a police office in southwest Sichuan province calling for freedom for Tibet and the return of their spiritual leader, the Dalai Lama, Free Tibet said in a statement. It said it was the first documented case of a triple self-immolation.

The youngest monk, identified as 15-year-old Dorjee, died at the scene and his companions, Samdup and Dorjee Kyab, both 16, were taken to a hospital by security forces and their conditions were unknown, Free Tibet said.

Then in the evening a 23-year-old Tibetan nomadic woman, Tamdin Tso, died after self-immolating in another ethnically Tibetan area in western Qinghai province, it said. She took petrol from a motorbike and set fire to herself in the family's winter pasture near Tongren, a monastery town, and her body was taken back to her family's home whether people gathered to pray, it said. She had a 5-year-old son.

Free Tibet's accounts could not immediately be confirmed.

A man at Qinghai provincial government's news office said he didn't know about the case and hung up. The Aba prefecture's communist party propaganda department referred queries to prefectural and provincial authorities, where calls rang unanswered.

Since March 2011, dozens of ethnic Tibetans have self-immolated in ethnically Tibetan areas to protest what activists say is China's heavy-handed rule over the region.

Chinese authorities routinely deny Tibetan claims of repression and have accused supporters of the Dalai Lama of encouraging the self-immolations. The Dalai Lama and representatives of the self-declared Tibetan government-in-exile in India say they oppose all violence.

Free Tibet said the three boys came from a village in Aba county, a region of high-altitude valleys grazed by yaks on the Tibetan plateau, and belonged to Ngoshul Monastery, which houses around 130 monks and is approximately 10 kilometers (6 miles) from Ngaba town where other self-immolations have taken place. Free Tibet said security forces had been deployed to the monastery and the nearby town of Gomang, and already heavy restrictions in Ngaba county had been intensified, with people unable to leave or enter Ngaba town.

"In just one day, on the eve of the Communist Party Congress, four Tibetans have set fire to themselves," Brigden said. "These protests are aimed at sending the next generation of China's unelected regime a clear signal that Tibetans will continue to fight for their freedom despite China's efforts to suppress and intimidate them."

Free Tibet says over two thirds of those who have self-immolated are younger than 25 and have grown up under Chinese rule. "Their protests belie China's propaganda that Tibetans are happy and thriving. Tibetans young and old, men and women from all walks of life across a vast area of Tibet are setting fire to themselves in protest at China's occupation," it said in a statement.

The Chinese government has poured money into the region for years to spur development and helping to raise living standards. But many Tibetans say China's tight control, including on religious observance, is draining them of their culture and identity.

Apple shares slump 4% to 5-month low

SAN FRANCISCO - Shares of Apple Inc slid almost 4 percent on Wednesday to a five-month low, outpacing the U.S. stock market's post-U.S. election losses, and slipping into bearish territory.

Stock in the world's most valuable technology company has dropped more than 20 percent from a record high in September, entering what the market recognizes as bearish ground. It hit a low of $558.38 on Wednesday, before trading down 3.5 percent at $559.74 around midday.

While Apple shares have appreciated 38 percent so far this year, the company faces unprecedented competition during the crucial holiday season as rivals such as Microsoft, Samsung Electronics, Google and Amazon.com Inc challenge its dominance in smartphones and tablets.

The company saw its market share slide to 50 percent in the key tablet arena, while arch-foe Samsung more than doubled its share to 18.4 percent, according to research firm IDC.

Analysts say the company remains a solid long-term bet, but uncertainty persists in the near term after CEO Tim Cook ousted veteran mobile software chief Scott Forstall and the company failed to meet analysts' expectations on its latest quarterly results.?

Oh Ne-Yo you have just never been right with me. I remember listening to your CDs and just wanting you to break out of your Michael Jackson copycat mode. I wanted you to test your talents. I think you are a rather talented dude but you seem to be OK with being stuck in a very boring lane.

So I was really not checking for you or this new CD. Honestly, Ne-Yo I didn?t even know you had a new CD coming out and what does that say?

But you know I held out hope for you as I pressed play on my iPod to listen to R.E.D. for the first time.

I got a little excited when I heard the first 2 tracks of your new CD. I really like Cracks in Mr. Perfect and Lazy Love is a nice little track too. But then Ne-Yo you went WAY left of center. You turned right at Albuquerque when you should have turned left.

You went off into this dark crazy pop Chris Brown, LMFAO land of horrid music. Ne-Yo did you lose your way? What were you thinking? Is this your way of expanding your horizons?

Track after track after track it just kept getting worse. I started calling your name?Ne-Yo! Ne-yo! Where are you?! Come back Ne-Yo I won?t talk about your Michael Jackson copycat sound ever again! But for the love of all things symphonic please stop making this kind of music!

About 10 songs in I realized that I couldn?t see a light at the end of this horrible musical tunnel. Where is the light Ne-Yo! Step into the light Ne-Yo! Then it dawned on me there are 17 damn tracks on this CD! 15 too many if you ask me! Ne-Yo why 17? Who does that? 17 isn?t even a nice number! What were you thinking, Ne-Yo?!

Then it finally ended! The CD was over! I could breathe again!

I?m going to be honest with you Ne-Yo this CD was not very good. Matter of fact it was whack, whacktacular even!

Ne-Yo I beg you to never make another CD like this again! It hurt to even listen to this CD. Please Ne-Yo! Please don?t ever make a CD like this again.

Compton, California?s Kendrick Lamar hit the ground as an MC to really pay attention to during his run in the early to mid-2000s in the independent Hip-Hop scene through his own solo mixtapes and group releases as a part of the Black Hippy collective.

After dropping the deservedly critically acclaimed and independently released ?Section.80? full-length project in 2011, he was scooped up by Dr. Dre?s Aftermath Entertainment to start work on a major label full-length release.

Per usual in the Hip-Hop scene, there were worries that the uniqueness of Kendrick Lamar?s style ? the average guy rapper who acknowledges his environment in a dangerous area but won?t be trapped by it mentally or artistically ? would either be crushed, hidden and compromised by the Aftermath/Interscope label machine or that his 1st mainstream album would be milk-carton status on arrival, lost and never to be listened to by anyone except the stray label interns who might be holding onto the ?Dextox? album for ransom.

While not a perfect project, ?good kid, m.A.A.d city? ranks as one of the most solidly constructed and creatively expressive albums that have dropped in 2012 from any of the major label cliques and crews.

Besides opening up Kendrick Lamar to some of the best production money can currently buy and some nice marketing dollars, it seems like Dr. Dre?s direct hand in the 12 track collection of songs was pretty minimal ? and it works out for the best.

The production on this album is insanely on point and fits the young MC?s flows & song construction perfectly. Quality contributions of soulful mellow grooves, boom bap elements and bouncy funk (parts heavy, parts minimal, parts ?G-Funk?) by Pharrell, Hit-Boy, Just Blaze, T-Minus, Scoop DeVille, Like of Pac Div, Skhye Hutch, Tha Bizness, Terrance Martin and more really make this a release straight ready for heads to ride to in the car or mellow out with in the home spot.

The subject matter on ?good kid, m.A.A.D City? goes through thought conflicts about Kendrick Lamar?s love/hate relationship with his home area of Compton plus his ?can?t live with it, can?t live without it? viewpoints on the music industry, women, gangs, life as a whole and the myth/reality American Dream itself.

Kendrick Lamar?s gift is being able to tie all of these thoughts together in to a cohesive, smart and FUN album to listen to.

Sometimes these kind of theme albums can get a tad too pretentious, boring or preachy. His average guy vibe, pretty cool song writing skills along with a really smooth and lively flow and REALLY smart, direct and to the point lyricism really save the day. He wants to get a point out there, but is able to acknowledge that he has to actually craft quality songs to get those points across.

There are some relatively minor issues with the album.

A bit of the skit material drags on for a tad too long along with some weird spacing in between hooks on various songs. The while the vast majority of this album flows smooth like butter from track to track, joints like ?Poetic Justice? are a little jarring with trying little too hard to pander to the current mainstream radio trends of salacious ?get the girls? songs and the ending song ?Compton? ? while it does knock ? feel a little derivative of West Coast G-Funk hometown pride songs. A LITTLE more tightness on those ends could?ve made ?good kid, m.A.A.D City? damn near perfect.

?good kid, m.A.A.D City? at the end of the day isn?t just a fine display of a young MC on the rise with his talents and fame, but an example of what can happen when the label actually more or less leaves an artist alone who has built up their own indie fame by crafting a sense of authenticity and skills with the music and letting them just do them. Hip-Hop can reach for the stars if folks actually allow everyone?s unique talents to breath a bit.

Kendrick Lamar has put out a very solid project that?s not pandering to the harsh schisms of the current mainstream rap world for male MCs ? either being placed into a ?nihilistic gangsta? box or a pseudo ?lover boy? corner ? and coming out out the better for it. As of now at least, the good kid has actually found and succeeded as an artist in the m.A.A.D City of payola fame and music industry games.

Hope that audio saga continues.

What?s the first thing that jumps into your head when I say the name Macy Gray? ?Wacky haircut? Raspy voice? Funky clothing or huge sunglasses?

Sure Macy?s had a few hits in her day, and I?m willing to bet a bunch of you probably still have ?I Try? hiding on your iPod somewhere.

But in the end, Macy Gray is more of a personality than a songbook. Going to a Macy Gray concert isn?t so much a chance to hear her unique songs or artistic statements as much as it?s simply a chance to be a part of a retro-soul vibe for a few hours. You get the feeling a lot of players have Macy Gray songs on their make-out playlists, but don?t listen to her otherwise.

Not that there?s anything wrong with that ? especially if retro soul is your thing, but that in the end it seems like fans appreciate her overall style more far than they?re worried about the substance of what she?s doing. Macy Gray is a mood, kinda like soft jazz or that whole Michael Buble/Seth MacFarlane swing music thing.

So if you look at it that way, the fact that most of her music sounds exactly the same probably isn?t that big a deal in the larger scheme of things for her fans.

But as an artist, it sort of paints you into a corner.

And when you think of it that way ? the fact that Macy Gray has now released two albums of cover songs in the same year starts to makes a little more sense.

Famous musicians are kinda funny when it comes to breaking themselves out of creative ruts ? because you don?t want to stop the money train from showing up or alienate any of your hardcore fans, but if it?s not inspiring you to write new songs anymore, what can you do?

If you?re ?Macy Gray, you do exactly what a lot of other artists do ? you hire Hal Willner to produce your album.

Most of you have probably never heard of ?Hal Willner, but he?s kind of a legendary figure in the?industry. ?In addition to his work as an avant garde musician, Hal?s had a long and successful?career working as a composer of music for television shows based out of New York ? especially those looking to have music that sounds like popular songs on the radio. For example, Hal Willner writes the music for many of the parody songs on Saturday Night Live.

But what Hal Willner is most famous for are the albums he produces for artists who are looking for a way to express themselves outside of what their fans expect of them. He?s sort of the record industry?s crazy idea guy who says ?What if we got Elvis Costello to sing a bunch of Neil Young songs?? or ?Wouldn?t it be cool if we got a bunch of free jazz guys to do their versions of Sting??

Or to put it a little more simply, Hal Willner was the guy who put Lou Reed and Metallica in the same room to record an album version their interpretation of a 90 year-old Polish opera about a prostitute who wishes she was a dog.

This same Hal Willner was the guy who produced Macy Gray?s earlier 2012 release?Covered that saw her singing songs by Arcade Fire and Radiohead. It wasn?t particularly good (as I said in my?review) ?? but it seemed to re-energize Macy. So much so that she started discussing other ideas with Willner, who suggested Gray should re-interpret an entire album ? make it a tribute of sorts.

And so, Macy Gray?s version of Stevie Wonder?s album Talking Book was born.

Now before we do anything else let me say something ? having Macy Gray sing an entire album of Stevie Wonder songs was a great idea. Especially this album, which is a classic in it?s own right, but according to interviews was a also favorite of Macy?s when she was growing up. Not to mention the timing that puts the disc on the shelves on the 40th anniversary of it?s original release date, making it sort of a well-timed birthday present and honorary tribute for Stevie Wonder all at the same time.

And for her part, you have to imagine the process of learning, re-arranging, and presenting songs you?ve loved all your life was an amazing thing for Macy Gray to be a part of, especially for an artist possibly searching for new?inspiration ?but then when you crack the seal and start listening to the thing what you get is..

..More of that same Macy Gray wheezy-voiced slow-tempo crap she always comes up with.

I?m all for messing with conventions and trying things in different ways, but it seems like the plan here was to just slooooooowwwww everything down and drag things out ? which is an interesting twist at first,?but because this is an entire album, track-by-track (deep cuts included) what you end up with is a deep desire to find your original copy of the LP so you can get all the keyboard solos and energy back.

Hardcore fans might like this laid back approach, but really ? If the original groove to?Superstition was too bouncy and upbeat, why were you listening to Stevie Wonder in the first place?

Prosecutors allege 5 women in general's sex crimes

FORT BRAGG, N.C. (AP) ? U.S. Army prosecutors offered the first details of a rare criminal case against a general, alleging in a military hearing Monday he committed sex crimes against five women, including four subordinates and a civilian.

An Article 32 hearing on evidence in the case against Brig. Gen. Jeffrey Sinclair opened Monday at Fort Bragg, a sprawling post that is home to the 82nd Airborne Division. Officials said it was expected to last at least two days.

Sinclair faces possible courts martial on charges including forcible sodomy, wrongful sexual conduct, violating orders, engaging in inappropriate relationships, misusing a government travel charge card, and possessing pornography and alcohol while deployed. He served as deputy commander in charge of logistics and support for the division's troops in Afghanistan from July 2010 until he was sent home in May because of the allegations.

Before prosecutors could begin presenting their case Monday, defense lawyer Lt. Col. Jackie Thompson said military investigators had violated Sinclair's rights by reading confidential emails he had exchanged with his lawyers and wife discussing the accusations against him.

Under questioning from Thompson, the lead investigator in the case acknowledged she had read the confidential e-mails, violating the terms of the subpoena used to obtain them from Sinclair's service provider. Those e-mails were later turned over to prosecutors, who are barred from seeing Sinclair's communications with his counsel.

Thompson then asked Criminal Investigative Command Special Agent Leona Mansapit if she had the resources she needed to conduct a proper investigation in Sinclair's case.

"Probably not, sir," Mansapit replied. "I wish I had."

The defense is asking the hearing officer, Maj. Gen. Perry L. Wiggins, to either require all new prosecutors be assigned or have the case thrown out.

Until now, the Army had kept details secret in the rare criminal case against a high-ranking officer. In other high-profile cases, Army prosecutors have been quick to release charging documents.

In March, the Army quickly released charge sheets laying out evidence against Staff Sgt. Robert Bales, the soldier accused of gunning down 17 Afghan civilians in a massacre in southern Afghanistan.

The first Article 32 hearing in Bale's case also began Monday across the country at Joint Base Lewis-McChord south of Seattle, Washington.

There have been only two other court-martial cases against Army generals in recent years.

Prosecutors in Sinclair's case alleged at Monday's hearing that the crimes occurred between 2007 and 2012 in places including Iraq, Afghanistan and Germany, as well as Fort Bragg and Fort Hood in Texas.

In one case, prosecutors also said that Sinclair threatened one woman's career, as well as her life and the lives of her relatives, if she told anyone about his actions.

Sinclair's attorney asked for the charges to be thrown out, arguing that the prosecutors had read confidential emails between the general and his defense. Defense attorney Lt. Col. Jackie Thompson said this violated his client's rights and asked that new prosecutors be brought in to try the case.

The hearing officer called a recess until early Monday afternoon to give a legal adviser time to review the documents.

A new study by scientists at the University of Miami (UM) Rosenstiel School of Marine & Atmospheric Science uses Interferometric Synthetic Aperture Radar (InSAR) data to investigate deformation prior to the eruption of active volcanoes in Indonesia's west Sunda arc. Led by geophysicist Estelle Chaussard and UM Professor Falk Amelung, the study uncovered evidence that several volcanoes did in fact 'inflate' prior to eruptions due to the rise of magma. The fact that such deformation could be detected by satellite is a major step forward in volcanology; it is the first unambiguous evidence that remotely detected ground deformation could help to forecast eruptions at volcanoes.

"Surveying entire volcanic regions using satellite data is of primary importance to the detection of ground deformation prior to the onset of eruptions. If volcanic inflation is observed, it can help us to predict where the next eruption may occur. Moreover, in regions like Indonesia, where volcanoes are prevalent and pose a threat to millions of people, and where ground-based monitoring is sparse, remote sensing via satellite could become a major forecasting tool," said Chaussard.

Analyzing more than 800 InSAR images from the Japanese Space Exploration Agency's ALOS satellite, the team surveyed 79 volcanoes in Indonesia between 2006 and 2009. They detected deformation at six volcanic centers, three of which erupted after the observation period, confirming that inflation is a common precursor of volcanic eruptions at west Sunda volcanoes.

"The notion of detecting deformation prior to a volcanic eruption has been around for a while," said Amelung, who has been studying active volcanoes for 15 years. "Because this region is so volcanically active, our use of InSAR has been very successful. We now have a tool that can tell us where eruptions are more likely to occur."

The team will now study other parts of Indonesia and then in the Philippines, also prone to volcanic activity. They will use data from the Japanese Space Agency's ALOS-2 which will be launched next year.

"The monitoring of changes to the Earth's surface helps us to better predict the onset of volcanic activity, which can have devastating impacts on human life," said Amelung. "Like with earthquakes and tsunamis, however, we cannot predict activity with certainty, but we hope that new tools like satellite remote sensing will help us to gather critical information in near real-time so we can anticipate the risk of eruptions and deploy resources in a timely manner."

This study also reveals that there are regional trends in depths of magma storage. Indonesian volcanoes have magma reservoirs at shallow depths probably due to the tectonic setting of the region, which account for the way the region is deforming. If a volcanic chamber is located close to the surface it is usually associated with a higher risk for significant eruption, thus these observations play a major role in volcanic hazard assessment.

Android 4.1.2 update for Galaxy Note could add Nature UX, multi-window feature

Samsung has already provided a wealth of software upgrades for the original Galaxy Note, which first shipped just over a year ago on Android 2.3-based firmware. Now signs seem to point towards the OG Note being updated directly to Android 4.1.2 Jelly Bean, as part of an upgrade that'll include two major new features -- the TouchWiz Nature UX, and the multi-window feature from the Galaxy Note 2. Multi-window was a showcase feature for the Note 2, allowing multiple apps to be used on a split screen at any time.

Reports from SamMobile indicate that a new firmware version, N7000XXLS3 is in testing at Samsung, and includes the Nature UX and multi-window support, in addition to limited "air view" floating cursor support using the S Pen. And today a video has surfaced from French YouTuber Jimmy Nodet, which seems to show an even newer ROM -- N7000XXLS7 -- in action. The (admittedly shaky) footage shows the TouchWiz Nature UX running on an original Note, as well as fully-functional multi-window capabilities. The video description claims this is an "official Android 4.1.2 update" for the international Galaxy Note. That doesn't guarantee its legitimacy, but on the other hand the video doesn't match any custom ROM we're familiar with.

Last month rumors suggested Samsung would also bring multi-window to the international Galaxy S3, in an Android 4.1.2 update slated for December. If the original Note was to get the feature, it'd certainly make sense for it to appear on the S3, too.

Of course Samsung hasn't announced anything officially, but there are a lot of original Galaxy Note owners out there who'd be very happy if these reports turned out to be correct. Nevertheless, until the updated software out of Samsung's internal testing circles and available for download, Note owners would be advised not to get too excited.
